Market Manipulation? India Claims Samsung and Xiaomi’s Exclusive Deals Hurt Smaller Retailers!

India’s Competition Commission (CCI) has accused major smartphone manufacturers, including Samsung and Xiaomi, of colluding with e-commerce giants Amazon and Flipkart to engage in anticompetitive practices. The findings suggest that these companies have been conducting exclusive product launches that violate local competition laws, thus harming smaller retailers and undermining fair market practices.

The CCI’s extensive investigations reveal that Amazon and Flipkart have given preferential treatment to select sellers, prioritizing their listings while offering steep discounts. Siva Prasad, additional director general at the CCI, emphasized that such exclusivity is detrimental to consumer interests and stifles free competition.

According to a 1,027-page report on Amazon and a 1,696-page report on Flipkart, the CCI found that Indian units of Samsung, Xiaomi, and other smartphone brands such as Motorola and OnePlus engaged in exclusive launch practices. These findings, dated August 9, have not yet been made public, but they could spell trouble for the implicated companies, increasing their legal and compliance challenges.

E-Commerce Growth Amid Controversy

Despite the controversy, the Indian e-retail market is booming, projected to exceed $160 billion by 2028. Currently, Samsung and Xiaomi dominate the smartphone market, holding nearly 36% of the share. The CCI’s investigations were initiated in response to complaints from the Confederation of All India Traders, representing millions of small retailers who feel sidelined by these practices.

Both Amazon and Flipkart have been accused of using foreign investments to subsidize rates for select sellers, further entrenching their competitive advantage. These strategies have not only affected ordinary sellers but also brick-and-mortar retailers, who have found themselves receiving new models much later than their online counterparts.

As the CCI prepares to review objections to its findings, it may impose fines and enforce changes in business practices for the companies involved.
